Pennsylvania and New Jersey Sex Discrimination Attorneys

Federal, state and various local laws in the Philadelphia area and throughout Pennsylvania and New Jersey prohibit employment discrimination on the basis of sex. Other legislation further seeks to remove disparity in pay between men and women. When discrimination on the basis of sex or gender occurs, these laws give workers the right to seek justice.

Employment Discrimination on the Basis of Sex

Under Title VII of the Civil Rights Act of 1964, the Pennsylvania Human Relations Act, the New Jersey Law Against Discrimination, the Philadelphia Fair Practices Ordinance and other local laws in the Philadelphia area, it is illegal to discriminate in employment decisions on the basis of sex. These employment decisions could including hiring, discharge, and promotion.

It is illegal, for example, to make a layoff decision based on the premise that an employee is a young woman who may marry and quit her job, to not promote a woman because the employer believes men are more aggressive, or to not hire a woman because the employer believes it will disrupt the all-male culture of the workplace.

While women have historically been discriminated against in employment, the law also covers any adverse employment decision made against a work because he is a man.

Harassment is a form of discrimination. If an employer creates or allows a workplace that is a hostile environment due to an employee’s sex, then that employee has been illegally discriminated against. Sexual harassment can include unwelcome advances or touch, crude remarks, “jokes,” pictures or illustrations about women or men or demands for sexual favors.

Equal Pay for Equal Work

The Equal Pay Act of 1963 is a federal law that prohibits discrimination in wages between men and women by an employer for jobs that require substantially equal skill, effort, and responsibility. The Pennsylvania Equal Pay Law and the New Jersey Equal Pay Act also add state protections.
