Anti-Discrimination Laws Protect Workers in New Jersey
If you are employed in New Jersey, there are many anti-discrimination laws that protect your rights. Some of the most important federal and state anti-discrimination statutes include the following:
- Title VII of the Civil Rights Act (Title VII);
- Americans with Disabilities Act (ADA);
- The Family Medical Leave Act (FMLA);
- Age Discrimination in Employment Act (ADEA);
- New Jersey Conscientious Employee Protection Act (CEPA) and
- New Jersey Law Against Discrimination (LAD).
Sex and Gender Discrimination
It is against the law for employers to discriminate against a person on the basis of sex or gender. Both men and women are protected by gender/sex discrimination laws. If you were discriminated against based on your sex/gender in New Jersey or were retaliated against for reporting sex/gender discrimination, you should consult with an employment lawyer immediately.
Race, Color, and National Origin Discrimination
Racial discrimination is prohibited under federal and state law. There are laws that prevent employers from discriminating on racial grounds, color-based grounds, and on the grounds of actual or perceived national origin. Employers cannot take action based on race, which includes any type of race-based differential treatment, not just termination. Furthermore, an employer cannot retaliate against an employee for complaining of or objecting to race discrimination, including informal and verbal complaints.
Age Discrimination
Age-based discrimination is also unlawful under federal and state regulations. Employers cannot discriminate against older workers on the basis of their age, nor can an employer retaliate against an employee for objecting to, or raising concerns about age discrimination.
Pregnancy Discrimination
Pregnant mothers have certain basic employment law rights. An employer cannot treat differently, terminate, demote, or deny a promotion to a worker because of her pregnancy or her need for maternity leave. Our New Jersey pregnancy discrimination lawyers protect the rights of expecting mothers and employees who have complained about pregnancy discrimination.
Religious Discrimination
Employees have the right to practice and observe their religion. If an employer discriminates against a New Jersey worker on the basis of their religious practices, then that employee may have a viable legal claim against the company. An employer also cannot retaliate against an employee for complaining of religious discrimination in the workplace.
Disability Discrimination
The ADA provides critically important protections to disabled workers. Companies covered by the ADA must give qualified disabled workers a fair chance to compete for positions and promotions, and must not discriminate against employees based upon their disabilities, including their record of a disability or being regarded as disabled. Discrimination based on stereotypes and prejudices against people with disabilities is unlawful in New Jersey.
Sexual Orientation and Gender Identity Discrimination
New Jersey’s Law Against Discrimination (LAD) has been amended to provide protection against discrimination based on sexual orientation and gender expression. While other states do not offer protections on these grounds, employers in New Jersey cannot discriminate on the basis of sexual orientation.
